Member Agreement & Terms of Use

These terms are short on purpose, and we mean what they say.

Last updated: 30 August 2026

Welcome. By joining Implemental Health as a member or using the brain-health viewer and coach, you agree to these terms.

1. What Implemental Health is — and is not

Implemental Health provides educational tools and subspecialty radiology second-opinion coordination: an interactive brain viewer, a virtual brain-health coach, a habits profile you build yourself, and access to specialist scan reads through our clinical partner, MDview.

We are not your doctor, and nothing here is medical advice, diagnosis, or treatment. A physician reviews all specialist reads; no diagnosis is automated. The coach is scripted educational software, not a clinician. If you are experiencing a medical emergency, call 911. Always consult a qualified healthcare provider about your individual situation, and never delay or disregard professional medical advice because of something you saw here.

2. Membership

Membership in our community is always free. We will only charge for upgrades that you select, and we will always show you the price before you pay anything. Membership currently includes the brain viewer, the virtual coach, and our research letter (at least quarterly). You can unsubscribe or end your membership at any time.

You must be at least 18 to become a member. If you use the tools on behalf of someone you care for, Section 6 applies.

3. Joining — what we ask, and what membership actually is

We ask for one thing: a working email address. No name, no date of birth, no health questions, no payment method. You give us the address, we send you a confirmation email, you click the link in it, and you are a member. That confirmation step exists so that the address is genuinely yours and genuinely works — not to put an obstacle in your way.

A few plain facts about how this works today, because we would rather you know than guess:

  • There is no password and no account to log into. Membership is your confirmed email address on our member list. Access to the members’ area comes through that list, not through a login screen.
  • Keep the email we send you. It is how you get back to the members’ area. If you lose it, write to support and we will send it again.
  • One person, one address. Please do not sign up with an address that is not yours.
  • Leaving is one click. Every email we send carries an unsubscribe link. Using it ends your membership, and there is no account left behind to close.
  • If the address you give us does not work, we cannot deliver what membership includes. That is the only reason we care whether it is real.

4. Your data — our promises

Our full Privacy Notice describes this in detail and forms part of this agreement, and our Consumer Health Data Privacy Policy covers rights specific to Washington and Nevada residents. The summary:

  • For a free member, what we hold is your email address. That is the whole of it.
  • Your habits profile stays on your device. The answers you give the coach are written to your browser’s local storage on the device you used; your in-session profile answers are held in the page’s memory and discarded when you close the tab. Neither is transmitted to us. We describe the limits of that claim honestly in the Privacy Notice rather than asking you to take it on faith.
  • We don’t hold your images or your radiology report. When you order a specialist read, you upload your scan directly to MDview’s secure portal. MDview is the reading facility and holds the clinical record — the images, the report, and the physician’s interpretation — as its own record under its own privacy practices. If you load an MRI file into our viewer, it is displayed on your device.
  • When we launch measurement, that changes, and we will say so before it does. Measurement means Implemental holding member-generated health data: assessments, adherence, and interval measurements. It is not part of free membership today.
  • Your email is used for the research letter, the members’ area, and membership notices. No spam; unsubscribe anytime. Our website runs on WordPress.com (Automattic), whose infrastructure hosts the site, processes the membership form, and holds the member list.
  • We use two analytics tools and we name both: Google Analytics 4, and Jetpack Stats (Automattic). Neither is used for advertising.
  • We don’t sell your data. Not to advertisers, not to data brokers, not to anyone. We don’t hand it to insurers or employers — not now, not as a paid feature later.
  • You can ask for a copy of anything we hold about you, or ask us to delete it, at privacy@implementalhealth.com. We answer within 45 days.
  • California residents: we offer you the rights described in the CCPA/CPRA — to know, to delete, to correct, to opt out of sale or sharing, and not to be treated differently for asking. We offer them because they are right, not because we are required to: Implemental LLC does not currently meet any of the thresholds that make a business subject to the CCPA. If we grow into them, this sentence changes and the rights stay.

5. The viewer and the coach — your license

We grant you a personal, non-transferable license to use the brain viewer and coach for your own (or your family’s) education. The viewer, the coach, the measurement technology behind them, and their content are protected by intellectual-property rights, including licensed patents.

The downloadable viewer is a member benefit, and it is licensed rather than given away. When you download it:

  • It is yours to keep and to use on your own devices, for your own or your family’s education, for as long as you like. It works offline, it has no login, and it does not phone home.
  • You agree not to redistribute it. Do not republish it, post it, host it, mirror it, share the file, or pass on the link we send you. If someone you know wants it, send them to the membership page — it is free, and it takes them fifteen seconds.
  • You agree not to copy, resell, scrape, decompile, reverse-engineer, or use it to build a competing service.
  • We are asking, and we are also relying on you. We are not going to wrap this in copy protection or expiring links, because that would make it worse software for the members who play fair. This paragraph is the protection. Please honour it.

The brain model shown is a standard research template (not any person’s scan); modeled changes shown in the viewer are illustrative, and the viewer says so on its face.

6. Using the tools for someone you love

You may build a profile for a family member or someone you care for, with their knowledge and permission (or on behalf of someone for whom you are a lawful caregiver or hold healthcare decision authority). You are responsible for having that permission. The same rule applies doubly here: the tools inform conversations with that person’s doctor — they never replace them.

7. Honest limits

Measurement has limits and we publish them: no professional body currently recommends brain MRI screening for people without symptoms; a single year of change in one person can be smaller than the measurement’s own error; illustrative content is labeled as illustrative. We would rather you hear the limits from us than discover them later.

8. The unavoidable legal paragraph

The services are provided “as is” without warranties of any kind, to the maximum extent the law allows. To the same maximum extent, our total liability to you for any claim arising out of the free services is limited to $100, and for paid upgrades, to the amount you paid us for the upgrade in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited, and nothing here limits MDview’s professional obligations for reads performed by its physicians. These terms are governed by California law; disputes will be resolved in the state or federal courts of Santa Cruz County, California, and you may always use small-claims court.

9. Changes

We may update these terms as the product grows. If we make a material change, we will tell members by email or a notice on the site before it takes effect. Continuing to use the services after that means you accept the change.
